Return policy
El Gato Tuerto Liquor Store ("we", "the store") sells alcoholic beverages for off-premise consumption to customers 21 and older. This policy covers in-store purchases, curbside pickup, and local deliveries within Florida.
ALL SALES ARE FINAL — NO RETURNS OR EXCHANGES
1. No returns, exchanges, or refunds
Due to the nature of the product and for health, safety, and regulatory compliance reasons, all sales are final. This applies to sealed, opened, or partially consumed products, and to situations involving change of mind, taste preference, or over-purchasing. Once an order has been delivered (including curbside and delivery), there are no exceptions.
2. Legally required exceptions
We comply with Florida law. In specific cases where the law requires it, we evaluate an appropriate remedy (replacement of the same product or refund):
- Manufacturer or government recall: if a recall is issued that makes it illegal or unsafe to sell or consume the product, we follow official instructions.
- Safety or quality defect at the time of sale: if a product is found to be adulterated or unsafe for consumption at the time of sale (as defined by applicable law), we will offer an appropriate remedy. Clarification: taste preferences ("it's corked", "I don't like it") are not defects.
- Billing or fulfillment error: if we charged you incorrectly or delivered something different from what appears on your receipt, we will correct the error.
Nothing here limits any non-waivable rights you may have under Florida law.
3. Florida disclosure requirement
Under Florida Statute § 501.142, the notice "ALL SALES FINAL — NO REFUNDS OR EXCHANGES" is posted at the point of sale. If you request a written copy of this policy, we will provide one.
4. How to request help in exceptional cases
If you believe your situation falls under one of the legal exceptions in section 2:
- Contact us within 48 hours of the purchase or delivery.
- Do not discard the product until we give you instructions.
- Have your itemized receipt ready and, if applicable, the product in its original packaging.
- We may request reasonable documentation or evidence to evaluate the request.
5. Online order cancellations
You may cancel an order as long as it has not been confirmed by a cashier and fulfillment has not started. Once we begin preparing your order or payment has been collected, the transaction is final.
6. Age verification
To purchase or receive an order you must be 21 or older and present a valid government-issued photo ID. If we cannot verify your age or suspect fraud, we may refuse or cancel the order. If payment was already collected, we will issue a refund.
7. Governing law
This policy is governed by the laws of the State of Florida. Any dispute will be resolved in the courts of the county where the purchase originated, unless the law requires a different jurisdiction.
